I understand how the repo works but how can they collect the balance owed if any after they sell the vehicle? Can they draft our paychecks?

  • 2. Dave    August 5th, 2008 at 8:14 pm

There is a website www.procra.com which stands for Professional Collateral Recovery Agents where repossession agents go to discuss laws and things that they deal with daily. You could go there and ask them what your rights are. If you are trying to get in the business, it is the best place to get good, solid, by the book advice.

I ran into a hard time after i had surgery and the bank repoed my car.Well when i got paid the following week a went to get my car back the bank said they no longer wanted to finance to me and if i wanted my car back i needed to pay it off in full.On top of the fact they was only giving me 24 hrs. to pay the money they raised my balance from $3,100 to $4,700.Is this legal?

I just bought a car from a buy here pay here lot in January. I called the the place where I got my car from and told him that I was going to be late in September. Everything was ok. I only have 1 payment left on the car. I wasnt even 30 days late and he repoed my car. Then he tells me that he wants both payments and the repossession fees for the car before I can get it out. We have been having problems since I got the car. The car is in my fathers name but I was the one making payments. He never wanted to talk to me always my dad although I was the one making the payments.

    My mother had her car repo’d after only missing ONE payment!! The SAME creditor she had been dealing with for 25+ years, and had purchased and paid off previous vehicles;
She recently filed a bankrupty around 2005; they said that was the reason why… That doesnt make sense… I was told you have to be AT LEAST 2 or more… Can someone please verify this for me?

Sometimes you can call the finance company for example chrysler if you haven’t had a payment extended in 6 months, they will grant it to you helping you out, I know we are having a hard time those of us that lost our jobs. I lost my job in April and have been struggling for 8 long months trying to do whatever I can to make my car payment, but I wasn’t able to do it. Chrysler Thank you for the loan I know it’s not your fault that you had to come get my car, I’ve been struggling hard trying to find a job and still am to this day. (still somewhat hopeful living in michigan)

  • 7. Pat    December 3rd, 2008 at 9:35 pm

So, from what I’m reading, a creditor can repo your vehicle after you miss 1 payment? And they can auction it within a week?

  • 8. Pat    December 3rd, 2008 at 9:38 pm

I always thought repos didn’t happen unless you missed several payments and the company actually gave you time (like 30 days or so) to get the money to them. Obviously, I’ve learned something.

Patrick: my vehicle was recently repo’d by the very same company. When I went to get my belongings from the car (and by their agreement) all property on and in the vehicle are to remain UNTOUCHED and nothing removed, but I can tell you they had a HUGE POD storage unit FULL of baby car seats, bags and bags of clothes, tools on racks, strollers!!! etc… The guy that took my car only had the concierge key and could not get into anything, therefore my personal stuff was left untouched. As for the “if you had paid the note” comment, I made arrangements on 11/9 with Capital One Auto, the guy marked my account to be paid 11/11 as a typo and was supposed to be 12/11, got NO calls NOTHING and woke up on 12/1 to them taking it. DO NOT USE CAPITAL ONE EVER…

For all the condescending attitudes towards people who like to make ignorant remarks concerning someones personal misfortunes, obviously have not experienced any hardships in their life. You should not be so judgemental.
Bad things happen to good people. It is unfortunate that creditors offer no help and leave consumers no choice. I would like to know what it is that people are doing that has somehow excluded them from from an imperfect world!

  • 11. Glenda    January 28th, 2009 at 5:52 pm

Where do you guys get the imp[ression that personal property is supposed ot go untouched? Repo companies are required to remove & inventory personal property and are allowed to bill you for that inventory. They are then to box or bag it so that YOU do not enter their storage lot. You should have no reason to go past the office lobby. The only way they are supposed to leave the property in the car is if they cannot open the doors, trunk, etc with damage to the vehicle.

my husband repos cars for a living if you are a reasonable p[erson and hand him the keys he lets you take as long as you need to get your stuff out and they don’t auction your cars off for thirty daysit is hard sometimes but if you will just talk to the bank they don’t really want your car if you keep intouch with them they will help you. don’t move an dnot tell them don’t cahnge your phone with out telling them and they will work with you

  • 13. Trace    February 4th, 2009 at 4:23 pm

I can’t stand it when I see people get so irate and beligirent when a company is only taking what’s theirs. If you don’t pay the bill you don’t keep it.

It’s unfortunate when unexpected things happen that prevent us from keeping up with our bills. But just remember it’s never yours until it’s paid off.

i too had my truck repo’d. a week later when i got it back, i had tools taken, my amplifier mounted under the seat was gone, about 25 CD’s, all of my change in my side console which was about 20 bucks, even my daughters makup that she leaves in the glove box. none of this was listed on the property report at the repo office which means its the repo guys that know there is no inventory list and they can take whatever they want and there is nothing you can do! professional auto recovery of florence south carolina. WARNING - IF YOU GET REPO’D. GET EVERYTHING OUT!!! my guy wouldn’t let me. he let me get my registration, eyeglasses, and and cell phone but said everything else couldn’t be touched then he vanished into the night and my truck was stripped except for a ripped seat coushin and some old muddy bungee cords. i guess they didn’t want that. then they charged me 50 bucks to get those back! scam and ripoff artists and there’s nothing you can do about it. i understand they have to pick up your car if you don’t make your payments, but it doesn’t mean they should have the right to rob you blind!!!

  • 15. JAMES    April 1st, 2009 at 8:25 am

I AM ABOUT TO BE FACED WITH MY TRUCK GETING REPOD BUT WHAT HAPPENS AFTER THE SELL THE TRUCK HOW DO I PAY THE BALLENCE OR DO I HAVE TO IM SO FRUSTERATED I DONT NO WHAT TO DO THERE IS NOONE OUT THERE TO OFFER ANSWERS UNLESS YOU PAY A LAWYER

  • 16. Bobby    April 20th, 2009 at 10:09 am

My truck was picked up April 6 by American Recovery Specialists in Greensboro, NC. They stole personal property from the truck totaling $200. I probably won’t see it again based on what I’ve read. Anyway, for other’s info, I was 4 pmts. behind. I was given 10 business days by Nissan to pay $2200 which covered the 4 pmts., late fees and $400 repo fee which went to the thieves! If I get any property back, I’ll let everyone know.

  • 17. Kevin    April 20th, 2009 at 12:26 pm

I’ve had vehicles repo’d in North Carolina. When the jokers show up at your house, if you want to surrender the car or truck, tell them you ARE going to remove your property. They have no way of proving what was on the car when you bought it, neither do you…but you can force these jerks to let you remove your stuff.

I had an incident once where the guy told me I couldn’t touch my stuff, I laughed in face as I opened my doors and begin to remove my stuff. I sat in the car, handed my stuff to my wife. I told him if he touched me or my wife, I would blow a hole through him big enough to drive that car through. I told him if he wanted to leave with the car intact, he best just sit his happy azz down and wait a few minutes. He did.

I’ve had one picked up where my stuff was stolen out of my truck too…and emblems removed. I went back to the car lot where I got it and paid my past due balance and got the truck back. A quick trip back after hours, a puddy-knife and a few minutes of my time…I got myself some replacement emblems off another truck there. Do that next time…they’ll learn to stop pulling this crap with people.

Had another one time that I carried and locked up in a barn that was trying to be repo’d. I told the finance company that they could talk to me like I was a person and not a crook or I’d mail them the car piece by piece. This was after they tried to smart mouth me and belittle me…I don’t play that. Told them I’d burn it to the dirt…I could care less…and told I hoped they WERE recording my conversation.

Last one I had repo’d…I locked it in my garage and ignored the repo man when he came to my house. I’d open the garage door in the morning for my wife and kids to get into our other car. I’d see the sitting across the street and I’d wave and smile at them. Then shut the door again and not answer the door when they knocked…really ticks them off.

Bottom line…don’t take crap off these vultures. They earn a living by profiting off other peoples misfortunes…buzzards..haha. Make sure you let them know who is in control and get your stuff BEFORE you give them anything…

  • 18. Kevin    April 20th, 2009 at 5:21 pm

    Hey James,

Don’t pay jack-schit buddy. It’s not your fault that those rapist repo your vehicle and then sell it for less than the note owed on it. If they’re gonna do stupid stuff like that, then they should have just let you keep it and work some type of payment plan out with you. But they don’t want to do that because they couldn’t be all big and bad and bully you.

About 1 out of every 100 repo-men is really a good guy and just trying to earn a living, they’ll try to work with you and they are understanding. The other 99…are azzholes and they think just because they are at your house that you are trash and no-good. I love it when I get one of those at my house…boy God do I love it.

What I like to do is buy a car or truck from a buy-here, pay-here lot. Then after about 6 months…start letting the payments slack. Then they’ll try to send a repo man after you…I love messing with these douche bags. After about a week of messing with them and wasting their time and gas…I pay what I owe. HA-HA…all those trips up and down the road for nothing. Really loved it during the 4+ bucks a gallon for diesel fuel…hahaha.

Forgot to tell you that last time they sent the “man” to my house…he threw a drink bottle out in my yard. I was watching him and I got his address and phone number off his truck. I drove 50 miles with that drink bottle…in the vehicle he was trying to repo…haha. I went to his business and tied that bottle to big rock and threw it through his window. Ha-ha…he knew it was me but he couldn’t prove it…hahahaha. I laughed all the way home. I love freakin’ repo-men…

Well we had a RV that was mine and my three young boys only home, like everyone else having financial issues. My husband finally got a fulltime job and I had contacted the collection agency about payments but no response, Well one Saturday morning my middle son comes running a police car and wrecker were coming. I thought well there goes my car, well it was the RV. I never knew what it felt like to be homeless, and I will never buy anything repossessed to gain from someone elses mis fortune.

  • 20. www.sjrecovery.webs.com    May 21st, 2009 at 10:28 pm

Not all repo guys are evil. I work hard to give people the opportunity to remove their goods, contact the bank and rectify the situation, etc. I’m a repo guy with a heart. Someone is going to repo these things and even though I’d rather it be someone like me, then someone who is not nice about it. I repo mostly big rigs, 18 wheelers, etc. It’s tough times and hopefully things get better for everyone.

  • 21. Bobbie Abbott    May 24th, 2009 at 8:18 am

I just think if the situation is going to leave you homeless and living in a tent, then you should receive a notice, they had our PO Box, I tried to contact. Just like the car they just want the property back. No payments, just pay in full. We had 50,000 invested in that RV we owed 25,000, now we have nothing and no means of getting it back.

  • 22. dan    May 24th, 2009 at 8:09 pm

well im sorry for everyones misfortune, i drive a tow truck making less than min. wage and just started a repo business to make it thru Obamas crisis, my friend is a small time car dealer and I honistly cant have pity on someone who “gets themselves” into this situation and finds joy in keeping food off of the car dealers table… Even the major dealers like chevrolet, ford, dodge are suffering look who all is suffering outside of you and they would be fine if they got paid every cent! How many car dealers lost their jobs this year (google it). and the repo man has to pay for over priced insurance $750,000.00 liability, and $1,000,000 bond. massive taxes and etc. only to be spit on, yelled at, hit, threatened with knives, bats, pipes, and shot at!!! a bad attitude humm, well i wear a bullet proof vest and have a 3/8″ steel plate lining the back of the cab of my truck so I can come home and see my wife and 4 yr old son every day. THE POINT IS, dont blame the dealer, or the repo man. Who is responsible for the vehicle and money, YOU (and Obama). so if a repo man shows up, be nice, respectable, and up front about everything, he has probably heard it and seen it before and 9 out of 10 has a gun too. If all else say a prayer, I do and God has protected me so far… still mad? write Obama before you have nothing left to be mad about!!!

  • 23. Missy    June 5th, 2009 at 8:50 am

If someone repos your car, do they have to leave a notice on your door or something so that you know what happened to your car? We walked outside to take our daughters to school and the car was gone. Citifinancial Auto never even told us they were going to repo. Our payment is 200 a month. We owe 759 in late payments. Is there anything we can do?

  • 24. faye    July 24th, 2009 at 8:18 am

well it like this my brother got a repo company and i have gone and helped him and he tells them first thing get your stuff out of even the tag off it and if we get it before they get up we are not to touch nothing in the car my brother makes a living doing this and he is a single dad paying his bills like all the rest out there working some times cars lots are the ones that you should be mad at because they send out the repo bussiness but bottom line is you can;t keep a car with out paying for it if you lose your job give the stuff back as far as the payments you got to be behind a while before they send out the repo man

  • 25. Darle-Ray    August 1st, 2009 at 2:09 pm

Kevin, Post # 20 & 21, How many cars have been repo’ed from you ??? You need to find some friends closer to home. The friends you do have you don’t open the door for. You laugh at them while closing the garage door. You waste gas (50 miles) to go see them & though rocks at their place when they are not home. Make your payments, turn your life around and HELP the economy get back on track, before your wife and kids find out that your real name is Ernest T. Bass

  • 26. Repossession Agent    August 5th, 2009 at 1:13 am

    Kevin,

Obviously you have not had the right repoe agents, for one I do not blame you for playing games with them because it is funny for only a short time.

Here is the issue with that if you are repoed by our company in this state (HIDDEN) you would be screwed once that garage door opened, when it is open is fair game most statesd are the same as you signed the contract at timeof purchase read the fine lines and repossession agents like our selves are 100% fully armed, trained and bonded and we are allowed to defend our selves by all means (Video Recorded) so next time it may be you with the hole as we had many times grounded a few customers by force.

Companies like our selves do not show up alone we run in teams of 10 by all means. And yes we are licensed in North Carolina maybe we will meet one day NEVER KNOW :)

However depends from state to state but be careful as next time you play games you may get the needle out of the hay stack that the last guy lost. Just for note it is not worth a fight because sooner or later they will grab the ride and you could be possibly walking home from the dentist or wherever you maybe. We made several walk before then we get the last laugh by giving customers who play games a quarter to call someone who gives a crap.

Remember we are not paid to care only to take the ride by all costs.

  • 27. Mary    August 13th, 2009 at 8:03 pm

My car was repoed, I didnt make a call and good ole UAC (Universal Acceptance Company) took it 3 days later. My fault. I called to find out where it was and they acted like they didnt have it picked up. After playing some games on the phone they finally admitted they had it…I went to get my things and they told me it would be $50.00…If I didnt have the car payment, why do you think I have $50!! Its my stuff…it wasnt in the car when I bought it!! SO I left it… It sucks to be unable to find a job and take care of children on unemployment. You would think people would be more understanding in this economy.

  • 28. Darle-Ray    August 14th, 2009 at 1:02 pm

    Repossession Agent,
Where can you get trained and licensed in NC. I think this type of job needs to change from the tooth less wonder bike gang image to Mr./Mrs. Professional and partner Mr./Mrs. Respect. I also think that the (reenactment) TV show Operation Repo causes most of their on problem by first impression. Thanks for any input. Just trying to get into the business north of W-S NC

For anyone who is going to be late on a payment. The best thing to do is call your finance company prior to your due date and get an agreement for payment on a later date. This lets the finance co. know that you are not avoiding them and you are aware your payment is due. Most times if you keep the promise of paying by the date you agree on, you will not have any problems. In response to statements above about personal property in a vehicle. Most companies I know have no problem letting a person get the property out of a car because if the debtor does not remove it, then the repo company has to remove, inventory and store it. This takes a good amount of time. The repo company I manage and the ones I have worked for find it much easier to let the debtor remove the property in trade for the factory key. This results in no key cutting fee to the debtor or the finance company and no fee for personal property to the debtor. Also this removes any worry a debtor might have about personal or valuable property being stolen or damaged by us the repo company. We try to do this on every vehicle we repossess. If finance companies could not use repo companies than none of them would risk loaning money out to finance vehicles.

  • 31. Unemployed Grandmother    November 4th, 2009 at 6:26 pm

I had someone come by my home today to repo my vehicle and he did not get it. Instead, I filed a Police Report against him for breaking and entering.

I live in my garage while everyone else live in the main house. I park the van in the garage because a couple times people messed with it and it costed me to change my windscreen and the headlams which was stolen.

Well this afternoon I was on my bed and the garage door which is on an automatic door opener was half opened. This guy came and uknown to me crept under the door. He pulled the string to detach the door from the automatic opener. I heard the door opening but it sounded different. So I looked out my door and saw this man looking at me while opening the door. That garage door is the main door I use to go in and out.

I asked him wtf he was doing in my house and he said he came for the vehicle. Man, I was so pissed off, I told him he has no right to break into “my” home, he was supposed to knock and identify himself not just to forced my door open.

We got into it for a while and he left. I called the Sherriff’s Department and they told me I can file charges against him for breaking and entering. He came back a second time just before the Deputy came to my home to take my report and I got his tag ad gave it to the Police.

Needless to say, he now has a trespass against him and if he ever show up on my property I will call the Vops and have him arrested.

I called the finance Company and told them they can get the vehicle but they will have to send someone else to get it. Now they are telling me that they have no one else who can do it. am now planning to leave it on the drivewa and have some friends of mine come and take all the parts they need. My balance is $2300 and the van is worth about $600.

  • 35. April    March 10th, 2010 at 4:10 am

Well I have a truck which is a company truck and that my grandmother pays the bills on. Well the repo men show up on my front steps tonight and saying that we haven’t payed the bill since December. Well we got our things out and give it over to them. Later we started going though the bill, and found that we payed ever month from December to Feburary by phone, and March isn’t due to the 28th of March. And we only own 1,500 on it. Pretty much the only reason i posting this is that i will never go though BB&T again. Well don’t know how this is going to turn out, but i’ll keep you posted.
